As an Indemnitor (CO-SIGNER) of a surety bail bond, it is your responsibility as the indemnitor to see that the premium is paid. The premium is fully earned as soon as the defendant is released from the custody of the Sheriff. It is not refundable. A bail bond is valid for one year from the date of posting, and in the event the defendants case continues for over a year, the indemnitor is required to pay the bail bond premium again. If there is more than one Indemnitor, then all are jointly legally and financially liable for all monies owed.
All expenses incurred by the bail agency as a result of the transaction of the bail bond, is the responsibility of the indemnitor/s (CO-SIGNER/S). Expenses that includes but is not limited to court imposed cost, posting fees, long distance calls, travel cost, notary fee recovery fee, etc...
If the defendant fails to appear
The defendant is obligated by the bail agreement to appear at each and every court appearance required by the court, and failure to do so will result in the forfeiture of the bail bond. Failure by the Indemnitor/s (COSIGNER/S) to act immediately, will result in additional expenses such as tracing fees, court costs, recovery fees, and attorney fees should legal action be necessary.
The indemnitor/s are legally liable for all expenses incurred
California law provides that the associated expenses can not exceed the face value of the original bond. (California Regular Code Title 10 Section 2081(d).
Getting off the bond liability
Your liability expires when the defendant has completed all their court appearances, the court exonerates the bond, and when all premiums owed have been paid. Collateral (IF TAKEN) will be returned when the bond is exonerated and all monies owed to the bail bonds agency has been paid in full.
As the indemnitor/s you do have the right to request that the defendant be returned to the custody of the Sheriff, if you have reasons to believe that your liability will increased. For instance, if you are unable to contact the defendant, or if the defendant has removed from his/her place of residency without informing you, or if you have reason to believe the defendant will not go to court as ordered.
In these cases you need to contact the bonding agency and, complete a document expressing your desire to be relieved of the liability of the bond, and authorizing the bonding agency to apprehend and surrender the defendant to the custody of the County Sheriff.
You will still be responsible for paying the cost of the recovery and surrender of the defendant. In most cases the recovery fee is usually ten percents (10%) of the penal amount of the bond, however, if traveling is necessary in the pursuit of the defendant, you are also liable for travel expenses.
